The new section 48D of the Internal Revenue Code is a provision in the healthcare reform legislation, the Patient Protection and Affordable Care Act (enacted on March 23, 2010), which establishes a 50 percent investment tax credit for qualified investments in qualifying therapeutic discovery projects.

The legislation allocates $1 billion to this program and applies to the two-year period 2009 and 2010. The credit is available only to companies with 250 or fewer employees.

The IRS is expected to publish final guidance on the new section 48D program on or shortly before Friday, May 21, 2010.
